COMPANION IQ PRIVACY POLICY

We at Companion IQ value your privacy and have created this privacy policy (this "Privacy Policy") to address our collection and use of your personal information ("Personal Information") in connection with your use of My AI Companion (the "Service"). Capitalized terms not defined in this policy are defined in the End User License Agreement ("EULA").

We may modify this Privacy Policy at any time. Such changes will be posted on our website and updated within our Service and, where required, provided to you by other notice. Your use of any of our Service after the effective date of any modification means that you consent to the modification. Please refer back to this Privacy Policy on a regular basis.

By clicking "I AGREE," or otherwise manifesting your consent to the Privacy Policy and accompanying EULA, when you sign up to access and use the Service, you acknowledge that you have read, understood and agree to be legally bound by the terms of this Privacy Policy and the EULA.

Please remember that you are responsible for helping to protect your Personal Information by safeguarding your device, passwords, and other login information.

PERSONAL INFORMATION WE COLLECT AND RECEIVE

When you register for and use the Service, and when you interact with us, we will receive certain Personal Information, as described below. You authorize us to collect and/or receive such information.

1. Contact Information.

If you would like to use our Service, you will need to provide us with your mobile phone number, and for certain functionality or subscriptions, you will also provide your email address, and home and billing address (collectively, the "Contact Information"). The Contact Information is used to provide you with access and support for the Service as well as any other service or information you request. You will have the opportunity to opt in and opt out of communications as required by law.

2. Account Information.

Besides your contact information, we collect information about your login information (username, password, etc.), your preferences, and any other information you provide to establish and set up an account during the registration process.

3. Payment Information.

For paid subscriptions to My AI Companion, we will collect payment information, which may consist of credit card or bank account information, in order to process your payment so that you may access and use My AI Companion.

4. Demographic Information.

We may ask for demographic data, such as city, state, country of residence, time zone, gender, birthdate and/or age. This information is used to provide you with proper access to the Service, comply with laws, and personalize and optimize your user experience with the Service.

5. Health-Related Information and Other Sensitive Data.

The Service is designed and intended to be used solely for informational and lifestyle purposes, including sharing your Check-In information with your Trusted Contacts, and allowing you to request and receive reminders to complete certain tasks, as you may elect from time to time.

Because you decide what information to share with the Companion Products during your simulated conversations, reminder interactions, Check-In interactions, or otherwise, we realize that we may receive health-related information, including mental health-related information, information about your gender or sexual orientation, information revealing religious affiliations, race, or ethnic backgrounds, or other sensitive data. When you choose to provide it, you consent to our receipt of the information. You are never required to provide any health-related or other sensitive information to us. You always have the choice of whether or not to provide us with information.

6. Information You Choose to Provide In Conversations and Other Interactions.

Because the purpose of the Service is, in part, to engage in a personalized simulated conversation, and personalize your experience with other features, we collect, process and store the content of your conversations and other interactions you have with the Service. When you choose to provide information to the Service, whether through voice, text, clicking on "buttons" or other links, or other electronic interactions, you are consenting to allow us to collect, process, record, transcribe and store your conversation with the Service and other content you share with the Service. This allows us to provide you with a better user experience because we have a better understanding of how you prefer to interact with the Service.

7. Other Information We Collect Using Technology or Other Sources.

In addition to the Contact Information, we may collect additional information (the "Other Information"). Such Other Information may include:

1. a. From Your Activity. Information that we automatically collect when you use the Service, including, without limitation:
   • ○IP addresses, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what features of the Service you may use or may not use, etc.;
   • ○Information about a mobile device, including but not limited to unique device identifiers, the mobile Service type and version (e.g., iOS or Android), telecommunications carrier and country location; and
   • ○Activity and usage information within the Service, including conversation content, duration of conversations, time of conversations, and data derived from your activity and usage.
2. b. From Cookies. We collect information using "cookie" technology. Cookies are small packets of data that a website stores on your computer's or mobile device's hard drive so that your computer will "remember" information about your visit. We use session cookies, which expire once you close your web browser, to help us collect Other Information and to enhance your experience using the Service. You may be able to turn off the cookie feature on your mobile device using your settings in your internet browser. However, if you decide not to accept cookies from us, the Service may not function properly.
3. c. Third-Party AI Technologies. Companion IQ uses artificial intelligence technology provided by third parties ("Third Party AI Providers") that is essential to operate and support the chat and conversation functionality of the Service. We receive data from these Third Party AI Providers in order to provide you with the Service.
4. d. Third-Party Analytics. We may use one or more third-party analytics services to evaluate your use of the Service, compile reports on activity, and analyze performance metrics. These third parties use cookies and other technologies to help analyze and provide us the data. By accessing and using the Service, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Service.
5. e. Other Sources – We may decide to obtain additional information about you from publicly available or other sources. If your consent is required, we will take steps to ensure that you have provided proper consent.

HOW WE USE AND SHARE PERSONAL INFORMATION

You authorize us to use Personal Information to provide you with the Service, support, maintain, and improve the Service, solicit your feedback, inform you about our products and services, to analyze use of the Service. You also authorize us to use the Personal Information to personalize and optimize your user experience in connection with your use of the Service, which requires that the Service "remember" certain content or elements of your conversations, selections, and preferences provided by you in your use of the Service. You also authorize us to share your Personal Information as described below. Other than as provided below, we do not share your Personal Information.

1. We May Share Your Information With Individuals Designated by You.

If, through the Service or another permissible method, you provided us with contact information for your Trusted Contacts or other third party(ies) ("Designated Contacts") who may receive information about your use of the Service, including Personal Information, we may share information with them. If you are a Trusted Contact for the benefit of another User, we may share your Personal Information that you provide to us, with that User. The information shared may include health information, mental health information, and content of your conversations or other interactions (or lack thereof) with the Service, to the extent you provided it, in accordance with the EULA.

Again, please understand that the Service is not a crisis or emergency service and should not be used for that purpose.

2. We Share Your Information With Third Party AI Providers.

Companion IQ uses artificial intelligence technology provided by third parties ("Third Party AI Providers") in order to operate and support the chat and conversation functionality of the Service. We may share your Personal Information with these Third Party AI Providers in order to support the personalization, conversational functionality, and other aspects of your use of the Service. Third Party AI Providers have their own privacy policies governing how they collect and use information. Any information shared with or otherwise collected by third parties is subject to the third party's terms and privacy policy. We are not responsible for the processing of Personal Information by these third parties.

3. We Share Your Information With Authorized Agents, Affiliates, and Service Providers.

We may engage other companies and individuals to perform certain business-related functions on our behalf. Examples may include providing technical assistance, order fulfillment, customer service, marketing assistance, and payment processors. Specifically, we use a third party payment processor, Stripe, Inc., to process all payments for the Service. By agreeing to the terms of this policy, you agree to the terms of service of our third party payment processor, and their privacy policy, which is available here: https://stripe.com/privacy. These companies will have access to your Personal Information only as necessary to perform their functions and to the extent permitted by law. We may also share your Personal Information with any of our parent companies, subsidiaries, or other companies under common control with us, as well as our attorneys and advisors.

4. We May Share Your Information In Connection With Business Transfers.

As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, your Personal Information may be part of the transferred assets or business.

5. We May Share Your Information In Connection With Legal Requirements.

To the extent permitted by law, we may also disclose your Information: (a) when required by law, court order, or other government or law enforcement authority or regulatory agency; (b) whenever we believe that disclosing such information is necessary or advisable, for example, to protect your safety, or the rights, property, or safety of Companion IQ or others; (c) to defend ourselves in a legal action or other dispute.

AGGREGATED INFORMATION

In an ongoing effort to better understand our users and further develop the Service, we might use your Personal Information to analyze it, anonymize it, and aggregate it in order to operate, maintain, manage, and improve the Service, and for other legitimate business purposes. This aggregate information does not identify you personally and therefore does not constitute Personal Information. We may share this anonymized, aggregate information with our affiliates, agents, and business partners or other third parties for other lawful purposes, but as noted, this does not include any data that can be traced to you.

RETENTION OF PERSONAL INFORMATION

We generally retain Personal Information for as long as you use the Service, for as long as we believe is reasonably necessary to (a) fulfill the purposes for which it was collected, (b) to defend, manage and resolve disputes, (c) comply with audit requirements, (d) comply with applicable laws, and (d) for other legitimate business purposes. When we no longer need to retain the Personal Information, we may either delete it, anonymize it, or isolate it from further processing.

ACCESSING AND MODIFYING INFORMATION

You may access, remove, review, and/or make changes to your Personal Information by contacting us at privacy@companioniq.org.

CONSENT TO AND OPT-OUT OF COMMUNICATIONS

As a condition of using the Service, you agree to allow us to make, and for you to receive, autodialed AI-powered text messages and artificial voice calls to the phone number you provided in the Service. If you choose to opt-out of these communication methods, some or all of the functionality of the Service may not be available. In addition, we may communicate with you through other means, and you have the ability to opt out of those communications as follows:

HOW WE PROTECT THE INFORMATION

We take commercially reasonable steps to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, there is no method of data transmission over the Internet, or method of electronic storage, that is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security.

CHILDREN'S INFORMATION

The Service is not designed for and should not be used by anyone under the age of 18. We do not knowingly collect Personal Information from children under the age of 18. If you are under 18, please do not give us any Personal Information. If you have reason to believe that a child under the age of 18 has provided Personal Information to us, please contact us at privacy@companioniq.org and we will endeavor to delete that information from our databases.

IMPORTANT NOTICE TO NON-U.S. RESIDENTS

The Service and its servers are operated in the United States and are designed to be operated by users within and residents of the United States, subject to applicable United States laws. If you are located outside of the United States, please be aware that any information you provide to us may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. As of the most recent effective date of this Privacy Policy, we do not intend to provide the Service to individuals outside the United States. If you are located outside the United States and choose to use the Service, you do so at your own risk.

NO SELLING OR SHARING INFORMATION FOR THIRD PARTY ADVERTISING PURPOSES

We do not disclose or otherwise share your Personal Information with third parties for advertising purposes. Accordingly, we do not "sell" or "share" your information as defined in the California Consumer Privacy Act (Cal. Civ. Code Sect. 1798.100 et. seq.) (the "CCPA").

DO NOT TRACK SIGNALS

Companion IQ does not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser "Do Not Track" settings and/or signals.
